Construction Litigation

We represent owners, builders, contractors, and suppliers in disputes arising out of construction, from defects in the finished work to fights over payment and delay. These cases are rarely between two parties; more often they involve many, each pointing at the others.

In construction cases, the number of parties and volume of evidence need to be grappled with to demonstrate the merits at a possible trial.

The disputes take familiar shapes: defects in design or construction, claims over payment and the security for it, delay and disruption, and disagreements about what a contract required. What complicates them is the number of parties. An owner, a general contractor, subcontractors, suppliers, and their insurers, each with a claim against someone else. Sorting a client's actual exposure out of that tangle, and keeping the case focused on it, is much of what these matters demand.

We handle these cases from single-family and manufactured homes to large commercial and multi-unit projects, including the component-part and materials claims that often sit at the center of a defect case. On the larger matters, the discipline is as much management as advocacy: keeping the work, and its cost, proportionate to what is genuinely at stake for the client.
